This book investigates whether treaty interpretation at the ECtHR and WTO, which are sometimes perceived as promoting 'self-contained' regimes, could constitute a means for unifying international law, or, conversely, might exacerbate the fragmentation of international law. In this regard, the practice of the ICJ on treaty interpretation is used for comparison, since the ICJ has made the greatest contribution to the development and clarification of international law rules and principles. Providing a critical analysis of cases at the ICJ, ECtHR and (...) WTO, both prior to and since the adoption of the 1969 Vienna Convention on the Law of Treaties, the book reveals how the ECtHR and WTO apply the general rules of treaty interpretation in patterns which are similar to those used by the ICJ to address difficulties in interpreting the text of treaties. Viewed in the light of the ECtHR's and WTO's interpretative practices, both the VCLT's general rules of interpretation and the ICJ's interpretative practice serve to counteract the fragmentation of international law.. In this paper the authors discuss the continuing dilemma for doctors who have to tell a patient that he has cancer, particularly the moment when he should confirm a diagnosis that most patients have already sensed. For the writers it is most important that the doctor should be a bridge for the patient to return to his everyday world from the physical and spiritual isolation which his disease has created.

Traditional approaches to conflict are oriented towards establishing (or re-establishing) consensus, either in the form of a resolution of the conflict or in the form of an ‘agree-to-disagree’ standstill between the stakeholders. In this paper, we criticize these traditional approaches, each for specific reasons, and we propose and develop the agonistic approach to conflict. Based on Chantal Mouffe’s agonistic democratic theory, the agonistic approach to conflict is more welcoming of dissensus, replacing discussion stoppers with discussion starters and replacing standstills with (...) contestation. We illustrate such replacements and develop this approach, we analyse technological conflicts in a concrete R&D setting: the global hydrogen economy. From this context, we focus on the conflict between the proponents of blue hydrogen (drawn from fossil fuels) and those of green hydrogen (created through electrolysis). We conclude by highlighting the advantage of the agonistic approach but also drawing attention to its own specific risk, namely, antagonism. (shrink)

We therefore argue that a processual model is more suited for studying the interaction in QHCs because it eschews matters of titles and identities. We develop such a model in which the QHC is (...) represented as a process of generating four types of value: research value, market value, political value, and societal value. We then apply this processual model in analysing real-life cases of friction in QHCs. Friction is seen, not as an interpersonal clash, but as a discrepancy between two or more value-creation processes that compete for limited resources. (shrink)

The individual's reaction to imminent death depends on his concept of the existential meaning of death.There are two main, but opposing, concepts, one positive and the other tragic. The first sees death as a transition to another mode of being. Within that three main modalities are to be distinguished, in which is considered either as an element in the cosmic harmony, the reintegration of the individual into the universal (the `Tagorian' mode); or secondly the possibility of man's external existence through (...) his transfer, together with his entire physical and psychological apparatus, to a realm of legend (the `Mioritic' mode); or thirdly the culmination of life, the moment of maximum existential concentration overflowing into the universe and encircling it (the `Rilkian' mode). The second concept, the tragic concept, sees death either as a desired solution, which puts an end to the nothingness of life (the `Tracklian' mode); or as a nonsense, as an absurd injustice of nature (the `common' mode); or as a necessity of which we do not know the meaning, a dialectical moment of eternal change (the `Stoic' mode). The psychological care of the dying involves identification with the patient's concept of death, in order to maintain his morale and possibly diminish his terror of death. The doctor must therefore be a good psychologist and a genuine philosopher, in the strictest sense of the word. (shrink)

This paper discusses methodological similarities between Collingwood's approach to causation and contemporary manipulability-based views. Firstly, I argue that on both approaches there is a preoccupation with the origin of causal concepts which further connects to the aim of establishing the priority of a certain concept/sense of causation as more fundamental. The significant difference lies in Collingwood's focus on the logical and historical priority (Collingwood's sense I) while in more recent theories the focus has been on psychology (i.e., on different philosophical (...) concepts of causation tested in psychological setting-- Woodward, Waskan, Gijsbers & de Bruin). Secondly, I argue that on both Collingwood's views and contemporary approaches (especially Menzies & Price, Price, but also Woodward) there is an important connection between causation and the agent's perspective. This can be subsumed under what Collingwood identifies as the main presupposition underlying causal thought: the relation between the agent's perceived situation and the agent's desired situation/ goal. More broadly, the recent views on causation under discussion share Collingwood's aim of elucidating the problem of causation through investigating causal knowledge and thus can be integrated with his wider project of addressing metaphysical issues through the means of epistemology. We propose the use of discussion structures as tools for analyzing policy debates in a way that enables the increased participation of lay stakeholders. Discussion structures are argumentation-theoretical tools that can be employed to tackle three barriers that separate lay stakeholders from policy debates: difficulty, magnitude, and complexity. We exemplify the use of these tools on a debate in research policy on the question of responsibility. By making use of discussion structures, we focus on the argumentative moves performed by the (...) parties involved in this debate. We conclude by discussing advantages and limitations of discussion structures and we trace several opportunities for further research on these instruments. (shrink)

Las simientes como bienes comunes se remontan a los orígenes de las civilizaciones e implican la conjunción de consideraciones de tipo natural, social, cultural, religioso. Las semillas como mercancías se arraigan a los inicios del sistema capitalista y la nueva manera (...) de entender las relaciones capital-trabajo y, en especial, el binomio capital-recursos naturales. El presente trabajo aplica principios y nociones marxistas que permiten arrojar luz en la idea de mercantilización a través de la tesis de la acumulación originaria y de la referencia a la acumulación por despojo. Octavio Paz fue un lúcido intérprete de su siglo. Este trabajo explora aspectos decisivos de su propia definición como poeta y ensayista, así como de su trayectoria creativa y crítica, altamente representativa de las transformaciones del artista y el escritor contemporáneos. Los ecos de sus experiencias, prácticas de sociabilidad y lecturas, unidos a su sensibilidad y lucidez, hicieron que ya desde sus primeros textos en prosa Octavio Paz contribuyera a la reconfiguración del ensayo como género. Proponemos leer algunos textos del (...) escritor mexicano en diálogo con las reflexiones de varios de los grandes refundadores del ensayo y la crítica en el siglo XX. Su búsqueda de una comunicación profunda entre poesía e historia, su esfuerzo por repensar críticamente la tradición, su exigencia de autenticidad y libertad en el quehacer del escritor, son algunos de los elementos que dieron lugar en sus ensayos a una nueva poética del pensar y a una nueva relación entre conciencia y transparencia. _El espejo enterrado_ (1992) ocupa un lugar clave en la producción ensayística del escritor mexicano Carlos Fuentes y lo confirma como uno de los más notables intelectuales de nuestro tiempo. La obra y la serie documental a ella vinculada se reprodujeron ampliamente para contribuir a la reflexión en torno al significado de los quinientos años del primer viaje de Colón a través del Océano Atlántico, así como también para pensar la posibilidad de una comunidad iberoamericana apoyada en una historia, una (...) lengua, una tradición cultural y un imaginario compartidos. Este ensayo de interpretación de la vida de América y España se piensa a su vez como una biografía de nuestra cultura y una autobiografía intelectual del propio autor. Fuentes encontró en un año tan significativo como 1992 una oportunidad dorada para escribir la biografía de una cultura que consideró unida por el que llamó “Territorio de la Mancha”, repensar la relación entre España y América y emprender una nueva valoración de su perfil, su destino y su aporte al concierto de las naciones en una nueva etapa del orden mundial. This review-article explores the new method that he propose, called “evenimential hermeneutics”, as applied to the relation to ourselves, to the world and to the general sense of being. These analyses lean upon an original way of thinking time, as born in each “sudden” moment. The paper also draws comparisons with Heidegger, Husserl and Lévinas, while proposing a (...) critical point of view on Romano’s thesis, concerning the relationship between the novelty of the event and the past, and its relation with desire and otherness. O romance A Selva contou com quatro edições ilustradas: A de 1939, coordenada por Roberto Nobre, a de 1949, realizada por Machado da Luz, a de 1955, realizada por Cândido Portinari e uma última em 1974 realizada por Júlio Pomar. A primeira edição ilustrada correspondeu a um projecto de encomenda diferente das edições seguintes, nomeadamente da que serve aqui de termo de comparação, a de Portinari (1955). Roberto Nobre pretendia que oito ilustradores traduzissem picturalmente A Selva a partir de uma (...) geografia imaginária que o livro lhes desse a ver. Sendo a Selva um território estranho para os pintores desta edição, fica deste projecto uma tradução pela ilustração de paisagens sem identidade pictural – lugares brancos no conjunto das edições ilustradas do romance de Ferreira de Castro. El pensamiento de Leopoldo Zea comienza a tomar cuerpo a partir de la década de 1940 y forma parte de un legado representativo para la filosofía latinoamericana y, más específicamente, para la Historia de las Ideas Latinoamericanas. Las reflexiones que volcó en sus libros, y que expuso en foros de discusión que recorrieron el mundo, estuvieron siempre empeñadas en desentrañar el sentido de nuestra historia, con el fin de esclarecer y organizar los saberes y las prácticas de nuestra vida espiritual. (...) Ello, sin perder de vista la necesidad de buscar todos aquellos modos que permitan articular nuestra cultura y nuestra historia con la cultura y la historia universales. Además, su vasta obra contiene importantes aportes que nutren el legado de una tradición siempre orientada a reforzar la afirmación de los ideales de libertad, la autonomía de los pueblos, la integración y, fundamentalmente, la prospectiva de "imaginar sociedades del futuro igualmente deseables para unos y para otros", tal como lo enuncia Don Leopoldo.L. Zea's thinking begun to take shape during the 1940s; they are part of a representative legacy to Latin American philosophy and, more specifically, to the history of Latin American ideas. The reflections in his books, also presented at discussion forums all over the world, always tried to disclose the meaning of our history in order to enlighten and to organize the knowledge and the practices of our spiritual life, this being so without neglecting our concern about the way our history and culture articulate with the universal history and culture. Moreover, his work nourishes a tradition always aimed at strengthening the ideals of freedom, people's autonomy, and integration, and especially the capacity to "imagine future societies just as desirable for all", as don Leopoldo would say. This article explores the main aspects of Aristotle’s scientific method in Meteorology IV. Dispositional properties such as solidifiability or combustibility play a dominant role in Meteor. IV (a) in virtue of their central place in the generic division of homoeomers, based on successive differentiation and multiple differentiae, and (b) in virtue of their role in revealing otherwise undetectable characteristics of uniform materials (composition and physical structure). While Aristotle often starts with accounts of ingredients and their ratio (e.g., solids that contain (...) a significant amount of water are liquefiable), the natural direction of his investigation is from observations regarding dispositional properties and their manifestation to accounts of composition and microstructure. Such passages tend to be easily syllogizable, a feature that—along with the criteria that shape his method of division—argues, I believe, for the compatibility of Meteor. IV with Aristotle’s theory of scientific inquiry. The concluding sections of my article deal more succinctly with reputable opinions and final causation in Meteor. IV.1–11 and with the relation between this treatise and Aristotle’s biological corpus. (shrink)

The starting point for this paper is a critical discussion of claims of psychological reality articulated within Borg’s (forth.) minimal semantics and Carpintero’s (2007) character*-semantics. It has been proposed, for independent reasons, that their respective accounts can accommodate, or at least avoid the challenge from psychological evidence. I outline their respective motivations, suggesting various shortcomings in their efforts of preserving the virtues of an uncontaminated semantics in the face of psychological objection (I-II), and try to make the case that, at (...) least for a theory of utterance comprehension, a truth-conditional pragmatic stance is far preferable. An alternative from a relevance-theoretic perspective is offered in terms of mutual adjustment between truth-conditional content and implicature(s), arguing that many “free” pragmatic processes are needed to uncover the truth-conditional content, which can then warrant the expected implicature(s) (III). I finally illustrate the difficulties their accounts have in predicting the correct order of interpretation in cases of ironic metaphor, i.e. metaphor is computed first, as part of truth-conditional content, while irony is inferentially grounded in metaphorical content (IV). Se propone que, dadas las potencias racionales de los seres humanos, cabe decir que el proceso inicia con la tenencia de posibilidades alternativas de acción. El agente, como principio controlador, determina el deseo dominante que ha de activar sus potencias en determinada dirección. La acción se produce luego de manea necesaria.

A potentially illuminating aspect of Aristotle’s study of material properties that has been explored far less systematically and comprehensively than composition is his reliance on structural characteristics that are imperceptibly small, but presumably inferable, if not with certainty, at least with a high degree of confidence. This article is meant to elucidate that aspect and to answer three main questions: What is Aristotle’s general explanatory strategy when it comes to the relation between capacities and microstructures? How does he refine certain (...) elements of his explanations, e.g., with respect to specific subtypes of structures and their interaction with the environment? The Author argues for a non-semantic theory of intentionality, i.e. a theory of intentional reference rooted in the perceptive world. Specifically, the paper concerns two aspects of the original theory of intentionality: the structure of intentional objects as appearance (an unfolding spatio-temporal structure endowed with a direction), and the cognitive processes involved in a psychic act at the primary level of cognition. Este artículo se centrará en las propuestas de Epicuro y Crisipo frente a la tesis de la necesidad lógica de todos los eventos del mundo defendida por Diodoro Crono. Se argumentará que Epicuro rechazaba este tipo de necesidad sosteniendo que el principio de bivalencia no es aplicable a las proposiciones sobre eventos futuros e indicando que no existen causas eternas que garanticen la verdad de dichas proposiciones dado que la causa de dichos eventos puede ser una desviación repentina de los (...) átomos. Se mostrará que Crisipo, en contraste, se sirvió de la validez irrestricta del principio de bivalencia para demostrar que existen causas eternas de todas las cosas y, no obstante, defendía que esto no implica la necesidad lógica de los eventos específicos del mundo. Anticipating the ethical impact of emerging technologies is an essential part of responsible innovation. One such emergent technology is the digital twin which we define here as a living replica of a physical system (human or non-human). A digital twin combines various emerging technologies such as AI, Internet of Things, big data and robotics, each component bringing its own socio-ethical issues to the resulting artefacts. The question thus arises which of these socio-ethical themes surface in the process and how they (...) are perceived by stakeholders in the field. In this report we present the results of a qualitative study into the socio-ethical benefits and socio-ethical risks of using digital twins in healthcare. Employing insights from ethics of technology and the Quadruple Helix theory of innovation, we conducted desk research of white literature and 23 interviews with representatives from the four helixes: industry, research, policy and civil society. The ethical scan revealed several important areas where the digital twin can produce socio-ethical value (e.g., prevention and treatment of disease, cost reduction, patient autonomy and freedom, equal treatment) but also several important areas of socio-ethical risks (e.g., privacy and property of data, disruption of existing societal structures, inequality and injustice). We conclude with a reflection on the employed analytical tool and suggestions for further research. (shrink)

Galeno divide la exposición de las cuestiones referentes al diagnóstico y tratamiento de las pasiones y los errores del alma de cada uno, porque su tesis principal, (...) que la estructura del alma es tripartita (racionalidad, emociones vehementes o pasiones y deseos), así se lo exige. En su opinión, el tratamiento de las pasiones difiere del tratamiento de las fallas cognitivas a que se refieren los errores del alma; cuya causa pueden ser pasiones y deseos inmoderados y falsas opiniones sobre bienes y males; que median, finalmente, en la elección de una vida mesurada o, por el contrario, inmoderada. El hilo que une el tratado sobre las pasiones y el tratado sobre los errores del alma son precisamente las falsas opiniones, que incrementan la violencia ejercida por nuestras pasiones cuando no hemos revisado las causas (creencias y deseos) de nuestra conducta excesiva, ni los juicios de valores con que estamos acostumbrados a juzgar las circunstancias cotidianas de la propia vida. Este artículo presenta una interpretación de dos discutidos pasajes de Metafísica VI 3 y XI 8 en los que se encuentra la argumentación de Aristóteles encaminada a evitar la necesidad universal con base en la existencia de las coincidencias. Esta argumentación ha suscitado múltiples e incompatibles interpretaciones desde la Antigüedad hasta nuestros días. En ellas se ha presentado la argumentación del Estagirita en un abanico que va desde comprenderla como una postura compatible con el más fuerte determinismo, hasta una que (...) requiere un muy generalizado indeterminismo. En diálogo con estas interpretaciones, se defenderá una lectura según la cual estos pasajes están diseñados para argumentar no contra el determinismo causal sino contra la predeterminación. (shrink)

RESUMEN La crisis de legitimidad de las democracias representativas y del proyecto de globalización económica ha colocado en el centro del debate público la capacidad de ciertos grupos intelectuales, tradicionales o emergentes, para intervenir en la esfera pública y normalizar o alterar el horizonte establecido de posibilidades politicas y económicas. La popularización de conceptos como "posverdad" guarda relación con una transformación del papel que se había atribuido históricamente a los expertos e intelectuales en los sistemas democráticos y la aparición de (...) nuevas figuras capaces de movilizar la sensibilidad colectiva. En este contexto se está produciendo una intensificación de la recepción de la obra de Antonio Gramsci como fuente de utilidades analíticas. Este artículo propone, precisamente, una revisión de la noción de "intelectual orgánico" como una herramienta esclarecedora para las tareas contemporáneas de la filosofía política. ABSTRACT The crisis of legitimacy of representative democracies and the economic globalization project has placed the power of certain intellectual groups, traditional or emerging, to intervene in the public sphere and legitimize or transform the current political and economic paradigm at the center of public debate. The popularization of concepts such as "post-truth" is related to a transformation of the role that had been historically attributed to experts and intellectuals in democratic systems and the appearance of new figures capable of mobilizing collective sensitivity. In this context, an intensification of the reception of the work of Antonio Gramsci is taking place, as a source of analytical utilities. Since its onset, scholars have characterized social media as a valuable source for data collection since it presents several benefits (e.g. exploring research questions with hard-to-reach populations). Nonetheless, methods of online data collection are riddled with ethical and methodological challenges that researchers must consider if they want to adopt good practices when collecting and analyzing online data. Drawing from our primary research project, where we collected passive online data on Reddit, we explore and detail the steps that researchers must consider (...) before collecting online data: (1) planning online data collection; (2) ethical considerations; and (3) data collection. We also discuss two atypical questions that researchers should also consider: (1) how to handle deleted user-generated content; and (2) how to quote user-generated content. Moving on from the dichotomous discussion between what is public and private data, we present recommendations for good practices when collecting and analyzing qualitative online data. (shrink)
